OPT马上就要过期了，公司刚开始办理H1，中间可能会有2-3个月的gap，想用H4过度一下。原来准备在美国转，昨天收到新公司的信，一定要等到收到H4的批准件，才会递交新的H1。H4现在办理时间大概要3-4个月，不想等那么久。
 

1. 我递交过140，回国签H4会有风险吗？-No problem, but I would suggest you to ask your new employer to file H-1 petition, not need to get the H-4. If the H-1 petition approval has no I-94 due to your status gap (H-1 filing is not in time), you just go to China to get the H-1. If your H-1 approval has I-94, then you just work with H-1 status. You still have F-1 grace period of 60 days, so you should have no problem to get the H-1 visa if necessary.

2. 有没有可能处境去墨西哥签证？
-Probably no. Check the US Embassy website in Mexico.
