-No. Because the I-140 was withdrawn, you can not use it to extend/transfer your H-1 anymore (this employer is really horrible to do that).

-You are out of status. Have you filed I-485 yet? If yes, you can stay in US legally.
如果不行还 有其他途径可 用吗？
-If you have filed I-485, you may just use EAD to work. If not yet, you may talk to your new employer whether they can sponsor your TN status. If yes, you just need to go to the US-Canada border to get the TN I-94 to come back to work (not need USCIS approval in this case). Your spouse can get the TD at the border at the same time if he/she has no other status.
