回复：请问8老师，pjiang老师或其他老师关于收养移民的问题

我持美国绿卡，离异女性，无孩，40岁。最近想收养在国内中国哥哥的小孩并把他带到美国。小孩6岁，与哥嫂同住。我在坛里搜索了一下关于收养移民的帖，略知一二。具体还想再请教老师。
 

1. 为了满足两年共同生活的要求，在收养前去办旅游探亲签证，还是收养后去办签证，哪个获得签证的可能性大？-Hard to predict.
 

2. 如果收养前办签证成功，6个月签证到期后，续签成的可能性大吗？-It is possible.  I have seen an adopted child extended his B2 status  successfully again and again for two years, and then the child filed I-485 by following to join to get the green card. This child was adopted by the H-1 holder and then entered US using B2 visa. The adopting parents became green card holders after adoption.


如不成，留下来没有了身份，如何处理？-You can become a US citizen, then the child can apply for the green card two years later. The child unlawful presence does not affect his/her green card application.


到了美国之后，再回中国办收养手续吗？-I am not sure. You had better ask the related department in China to see whether you can adopt the child when the child is in US.
 

3. 如果收养后办签证，应该申请哪一类签证？-B2.
 

4. 如果我转成公民（我可以转成公民）， 这个收养能行通吗？-Yes. Then the child can apply for the immigration visa to enter US after adoption. But the  procedure is complicate for a US citizen to adopt a child from China because you need to follow both adoption policies of China and US. You had better hire a lawyer or at least consult a lawyer for this kind of issue.

 

不好意思，一下问了这么多问题，只是不想贸然行事，有一个比较清楚的概念之后再开始行动。
