上次说我丈夫新H1签证批准了，可是律师忘了给我申请新的H4，旧的H48月底就过期了，所以我现在属于非法居留在美国。那我因为孩子小，在美国，我如果回国重新签证，特别不方便。国内不是有通过中信银行免面谈代签业务吗？
-Don't think you can do it because you are in US now. You only can apply for a visa when you are outside US physically no matter whether you apply for it personally or use 中信银行免面谈代签业务.


如果我把护照寄回国内，让亲友帮我办理代签业务，得到新签证，这样行不行？因为丈夫现在国内，他的新H1 approval notice 也在。
-Because your spouse is in China, there may be a problem for you to enter US independently from China unless you and your spouse enter US together (I am no very sure this, so talk to your lawyer). From my understanding, a dependent on H4 can be in the US if the primary person on H1 is abroad briefly for vacation. But if both of you are in China, the situation is different. If the primary person do not enter on H1,  a dependent trying to enter on H4 could be seen as immigration violation.          

另外我听说不是什么身份过期，在美国都有6个月的grace period 吗，
-There is not such grace period for H-1 or H-4 like your case.


我这样的能不能享有这样的grace period 呀？
