急问8老师 我是否会out of status 原帖技术故障，重贴

今年拿到H1B名额，10/1日生效，后被解雇，但从未跟USCIS取消过H1B。OPT  grace period期间转入新学校，现在是F1，到2014年2月截止。但I20上注明了10月1日H1B会生效。后找了新工作，新公司于9月file H1B petition with consular notification, 开始日期为12月2013。用了premium processing 服务，9月16日file，现在还未通过。请问8老师，10月1号以后我还能留在美国吗？是以什么身份停留？
