回复：请教8老师，填I-485的犯罪记录问题

 

请教8老师，我们的Eb1的I-140已经批准。准备DIY递交I-485。但有关犯罪记录的问题不清楚：我丈夫5年前因abuse我们的小孩，被法院判强制隔离12个月。在隔离期间接受心理辅导和abuse counseling. 6个月后我们全家又重新生活在一起。在整个过程中，他没有被拘押和被捕的经历。他再没有其他不良记录。

 

请教老师，1. 这个是不是犯罪记录？


我在I-485申请是要不要提这个？
-Yes. Need to answer "Yes" to Part C 1.b. " Have you Ever, in or outside US,
b. been arrested, cited, charged, indicted, fined, or imprisoned for breaking or violating any law or ordinance, excluding traffic violations ".

Then explain the entire case in a separate piece of paper, and provide the copy of the related court documents about this case with I-485 filing.

 

                  2. 如果要报告我要交什么材料？


会被拒吗？-Should not.

 

                  3. 如果不提，移民局会不会认为我们不诚实，拒绝我们的绿卡申请？会不会给以后的公民申请留不良记录？
