My 7th year H1 extension was failed due to USCIS loss of my I-140 appeal package (so my I-140 was dismiseed instead of pending then). My 6th year H1 visa was expired on Jan 13th, 2013, and I was temporarily unemployed from my center. My center successfuly re-extended my 7th year H1 on May 20th. And I also got my I-94 number back from Feb 8th, 2013-Feb 7th, 2014.
However, my center told they can't re employ me anymore 3 weeks ago because of short of money. So I still valid H1 visa, but I was unemployed from Jan.
So what is my current status? unlawful presence, out of status? Do I have to leave this country ASAP to avoid 180 days limit? (count from Jan 13th).
Can I do COS from H1-H4 here to keep my status legal? Do I have to do consulate process for my H4?
