Appealing I-140 Can file new

Dear friends,
My Outstanding I-140 is denied. The lawer want to approve that his preparation is enough and the reason is because the CIS's decision is too random, so he filed an appeal for me. I am wondering if I can file another outstanding case in the appealing period.
