回复：请教8老师一个问题，我用过AP后，老婆来美，是否可以申请H4签证

我已递交485， pending状态，排期2009年1月20日,申请过工卡，但没用过，一直是以H1（学术类）身份工作, H1身份将于今年9月15日到期。今年4月回去结婚了, 回美国使用了AP。下面的问题是：

1. 现在老婆来美，是否可以申请H4签证？
-No.

还是我必须回去，重新签次

H1, 携带她H4签证。但这个很麻烦，尽量避免。
-Yes. You need to get the H-1 visa, then she can apply for the H-4 visa together with your H-1 visa application, or apply H-4 visa some time later after you enter US using H-1 visa.

 

2. 如果不行，怎么办？

要申请B1探亲签证，就有移民倾向，可行吗？
-She can try it and you never know, but B2 status can not stay longer unless your PD will be current soon so that she can file I-485 before the B2 I-94 expires.

3. 如果她能申请H4来美，我的H1 9月15日身份到期后，为保证她的合法身份等到我的485排期，使她可以也递交485，我可能再续H1，但她的I-94 能更换吗？
