For reasons that obviously are not clear to you, your boss wants you to avoid paying tax this year (cash-exchange is still the good old way to evade the almighty IRS). USCIS does not give rat's ass to your taxation problem, as long as you maintain your employment status legal....i.e. the lawyer is probably right.
