非常感谢8老师.能麻烦再问4个问题.

(1)是不是因为如果我的H1b extension被拒了,就不能递交485了,所以你建议我现在就递交485.

-If your H-1 extension approval has no I-94 (equal to your status extension denial), your unlawful presence is counted from the date your I-94 expired, and if the ulawful presence is > 180 days, you can not file I-485.That is why I suggest you to file I-485 now. Of course, if you use premium processing to get the H-1 result, you may wait for a few days to file the I-485.

(2)如果我现在递485,就必须停止工作,直到我拿到EAD或者H1b extention approved,对吗?

-You can continue to work and if your H-1 approval has no I-94, you need to stop working and work again after you get the EAD or go to China to get theH-1 visa.

(3)如果在递交485后,我的H1b extention 被拒了,影不影响我的485申请.

-Correct.

(4)因为我有10天的gap,这个影不影响我的485申请.
