急！我先生想回国去工作，在美国的一家公司。我们家里NIWI-140被批准，但是I-485还没有递交（等待排期），这样的话，先生以什么样的身份比较好。

-He does not need a status in US because he works in China. Non-immigration status only works within US.

如果携中国护照回去而没有拥有H-1B的话，如果等到I-485的递交日期，在回美国递交I-485的话，是否会受到影响。

另外，如果我们现在提出公司帮助办理EB-1B的话，是否必须拥有H-1B后才可以办理。
