回复：请教8老师，皮老师， 关于I-824 FOLLOW TO JOIN的问题

我想咨询一下FOLLOW TO JOIN的问题，先生是加拿大籍华人，今年2月绿卡拿到。 我们是去年年初在他PD CURRENT以后结婚的。我是中国籍。目前在中国。 想咨询以下问题

 

1） 是不是我们需要走FOLLOW TO JOIN这个程序，他填写I-824表格？

-Yes if you can not enter US using a non-immigration visa.

 

2） 除了I-824外， 先生还需要提供什么文件，资料及相关证明公证文件？

-Copy of your marriage certificate, copy of his green card, copy of your birth certificate and other required documents based on the I-824 Instructions. After the I-824 approval, USCIS will forward the approved I-824 to the National Visa Center (NVC) and then, NVC will contact your spouse and send him the instructions. Then, he just needs to follow the NVC Instructions to provide what NVC ask.

 

3） 因为我们都是二婚， 他在提供资料时是否要有离婚公证等相关信息？ 虽然这个信息在他绿卡申请阶段早就提交过？

-Yes, both of you need to provide your 离婚公证.

 

4） 在先生提交资料的阶段， 作为配偶，我需要提供何种文件资料？

-See above.

5） 在他替我申请时， 是否可以不用请律师，我们按照USCIS的网站提交资料给加州移民局即可？

-Not need a lawyer. It is simple procedure,

6） 在何种情况下会导致他申请被拒？

 

  我们在申请材料之外是否要提供任何附件资料，比如照片， 比如我们的相聚的出入境记录等以加深移民官我们夫妻有正常探望的记录。

-Not now. May need this kind of information during your immigration visa interview.

 

7） 如果因为部分资料缺少， USCIS是否会发出补件要求， 这样的准备时间一般多长？

-Normally one month to repsond to the RFE.

 

  如果因为第1次递交材料缺少是否容易导致拒签？

-No.

8） 如果在美国收材料正常， 一般多久可以转到广州使馆？ 如果整个流程正常的话， 从先生递材料被收取起， 到我的签证下来，总时长大概需要多长时间？

-Normally one year, case by case.

  看网上写的资料大概是1年半？ 不知道是否是这么长时间？

-It is possible.

9） 如果USCIS收了我开始移民的材料，我是否就不能办理B1/B2签证去美国看望我先生，

-Correct.

  即使我去中信银行办理签证，也会因为我的状态由非移民改为移民，导致探亲签证被拒？

-You may try to get the B2 visa to enter US, then, file I-485 directly 3 months later after you enter US. If so, not need to file I-824. If you can not get the B2 visa, then file I-824 to apply for the immigration visa in China.
