我和太太一直用 EAD上班，上个月新的485 (current company sponsored)递上去，律师说要同时取消旧的485(pending more than one year)，那样旧的EAD就没用了，但新的EAD没下来，这期间我们的身份是什么？485 pending？我和太太都是合法工作吗？谢谢。

-Both of you do not need to withdraw the old I-485, and USCIS will put all of your information (old I-485 and new I-485) together for consideration. The lawyer is terrible. Actually, you do not need to waste money to file a new I-485 and just send a letter to ask USCIS to do the I-485 interfiling/transfer. The lawyer really just wants more money and does not do the best way for you.

If you withdraw your old I-485, you can not use the EAD to work, but you can still stay in US legally based on the new pending I-485.
