问各位老师一个比较特殊关于OPT的问题。

情况很特殊，第一个OPT 10月17日结束，早在7月就申请了17个月的extension，毫无问题的case。 8月底收到RFE，说雇主的E-verify号码不对，问了HR，提交一个号码，没想到补充提交的号码又错了，完全是HR把数字看错。10月23日（12个月OPT已经过期，本来由于OPT extension pending期间180天合法工作），整个申请denial，由于10月17日已过，马上失去工作资格。OPT结束60天的grace period将于12月14日结束。现在雇主承认了自己错误，下周争取早点开始Motion to reopen。

现在的问题是，Motion to reopen的processing time可能长至90天，但是合法身份在约45天后（12/14）就过期。请问各位老师motion to reopen的pending 期是否可以算做这同一个OPT extension 申请的pending期？也就是说，如果motion to reopen只要启动了，在结果下来之前，根据下面的条款，我就可以保持合法身份而不需再12月14之前出境？

”If their post-completion OPT expires while the 17-month extension application is pending, students who timely filed their STEM extension applications with USCIS will receive an extension of employment authorization after their current employment authorization expires, but for no more than 180 days.  “

另外，现在申请H1B并非选项。
