请教 8 老师：

有一朋友，本人有EAD， 目前用H1B 在工作。现在换新公司，正在进行H1B transfer 。但新公司任用的美国律师工作效率非常低，不知到什么时候才能办成。但新公司急需人手。想请问

1. 能不能先用EAD 工作，等 H1B transfer 递交后， 再转为H1B身份？

-After your employer file the H1 transfer petition, you can work for the employer and not need to use EAD. If you use EAD, technically, your H1 status is void, but you can continue to use EAD and also ask the employer to do the  H1 transfer, then you can go to China to get the H1 visa to come back in the future whe you are convenient. So, it is not a big deal to use EAD. Of course, don't forget to renew your EAD in advance up to 120 days before the old EAD expires.

2. 需不需要再另外办手续才能变为H1B身份，还是在H1B TRANSFER后可以直接转为H1B 身份？
