回复：请问8老师、皮老师: H1b 批准但需要回国签证

昨天h1b批下来了，但没有I-94.　公司律师说要全家一起回去中国签证，理由是签证官会说"Where is you wife?" Since she is out of status, we need her to come back before we can approve visa. 我希望我自己先回去，万一拒签的话，我妻子也可以在这里处理一些房子等事务．律师的说法对不对呢？

-If you and your wife's old H-1 I-94 and H-4 I-94 do not expire yet, it is fine for you to go to China to get the H1 visa and your wife does not need to do it. Otherwise, both of you need to leave US to get the H1/H4 visa.

还有律师说ds-160 "Did you ever out of status in US" 我要回答yes,

 

因为我的h1b有8个月＋4个月的waiting approve gap了

-What does it mean?

还有H1b的终止日期给延长了8个月，不知为什么．
