如果renew的h1b无效的话，

即便是得到一张新的I94,我的h1b也是不好使的，也算非法工作了？

-When you go to China and come back using a valid H1 visa and get the I-94 at the port of entry using the new H1 approval notice, you can work until your new I-94 expires (2013). Also, after you reenter US using a new visa, all of your status record will be re-counted from the date you reenter US and that means your previous violation of status  (if any) will be removed automatically.
