H1b visa.
学校给换title时，renew了H1b.在这期间我回国了。人在国内时Approval 了。可我回美时仍然用的是旧H1b, 得了一下I94' expiration 10/10/2012, 入镜日期是12/17/2011. Renew的那个approval date是11/15/2011, expiration date 是10/21/2013。学校说以最后一下为准，所以我在美国只能呆到10/10/2012.需要再重新持Renew的H1b入境，这样就能得一新的I94' expiration 是10/21/2013。
我昨天去了墨西哥，回来时美国这边死活不给我新的I94, 他们商量了半天，说我的renew I94是good.
我现在140 批了，想尽快交485. 问题1： 到底那个I94有效，我交485时可以写i94有效期是10/20/2013吗
-Based on my undertsanding, your employer filed the H1 amendment (equal to a new H1) which was effective before you reentered US using the old H1 approval notice (check the new H1 approval notice for the effective date to see whether my statement is true). So, when you reentered US using the old H1 approval notice to get the new I-94, this I-94 override the H1 amendment I-94 and thus, it resulted in your H1 amendment invalidity. Therefore, your status is valid until 10/10/2012, not 10/20/2013. Another potential issue is that you work under the old H1, but work on different job from the old H1 (because your new H1 amendment approval is invalid) and thus, USCIS might think you work illegally if they carefully check it though it is just possible. That is why I suggest you to go outside US to get the new I-94 card before you file I-485. The CBP officer did not think that far like me here and they said your H1 was fine. Did you submit the old H1 I-94 to the CBP officer when you left US for Mexico? If yes, you should have got a new I-94 when you returned using the valid H1 visa.
问题2：如果以最后为准，我先交485， 然后10/10/2012前出镜，再申请一下新签证会来可以吗，或者申请I131，持renew的h1b回美。这样可以吗？那我是不是需要把新的I94给补上，或者回被Ref?
-It does not removal my concern above. YOu have to leave US before the I-485 filing and then, use the new H1 approval notice to get the I-94 when you reenter US using a valid H1 visa (get a new H1 visa if your current visa will expire when you return).
问题3：有没有什么办法不用出镜的，工卡用什么帮助吗？
问题4：听说有什么情况就算是自动放弃485了，我这里没设计吧？
