回复：父母绿卡 - 婚姻公证遇到麻烦

现在父母在国内，年底会过来，计划到时候给他们申请绿卡。现在他们正在准备材料，结果在婚姻公证上遇到了问题。38年前结的婚，其实只办理了仪式，并未领证，这几天补领了结婚证，当然对绿卡申请无用的。昨天刚去当地公证处问了，现在很严格，说国内新的婚姻法已经不承认事实婚姻，不让办理。请问大牛们，我们该怎么办？

Your case belongs to you were born before your parents' marriage occurred (illegitimacy).The immigration law recognizes a father/child relationship for a child born out-of-wedlock if one of the following is true: the country of the child's birth does not distinguish between legitimate and illegitimate children, a parent-child relationship was established prior to the child’s 21st birthday, or the child is legitimated before the age of 18.

So, you just need a certificate (公证) of the relationship between you and your father, your birth certificate and provide the evidences of emotional or financial connection between you and your father since your childhood. See I-130 Instructions Page 3, #4. So, you do not need your parents' marriage certificate. Of course, not hurt you also to provide the "这几天补领了结婚证" though it is not helpful.
