老公现在公司正准备给申请EB-3。老公硕士，工作6年，但现在职位要求描述是本科3-5年工作经验或研究生1-3年工作经验。公司律师说，只能按工作最低要求本科3年来申请，所以只能申请eb-3.
现在又有一个工作OFFER，公司挺好，挺知名，但职位要求描述一样，本科3-5年工作经验或研究生1-3年工作经验。Hiring Manager 说99%可能性是EB2，该公司的律师也说，他们会尽量争取EB-2。
我的问题是，按照这样的描述，真的可以申请EB-2吗？
-It is fine for EB2. The position can be EB2 or EB3, depends on the employee's qualification. The only issue is that there may be more US citizen applicants to compete for this position because Bachelor with 3 years experience is also qualified for this position. But as long as the employer/lawyer can justify why your spouse is hired, not US citizen, it will be fine.
申请哪个类别是公司说了算，还是移民局啊？很是疑惑！请各位帮忙给看看，到底可不可以是EB-2啊？能不能相信这个后找的公司啊？谢谢了
