请教各位老师，h1b transfer中间的gap算unlawfully present in US吗？

先感谢各位进来看。

h1b transfer中间有一个多月的gap，所以现在准备境外激活，填DS160的时候有这样一个问题：

Have you ever been unlawfully present, overstayed the amount of time granted by an immigration official or otherwise violated the terms of a U.S. visa?

我的情况是等待新雇主file transfer的时候，旧公司就让我结束工作了，所以这一个多月没有pay stub。旧公司没有revoke我的h1b，I94也没有过期。

这样的情况，DS160的这个问题应该回答yes还是no？
