各住老师好!我有一份niw的140已批准, 而且用它做了h1b六年之后的延期,现排期到已交了485,但还保持h1b身份,如果485被拒,我的已批准的h1b在还没到期的情况下是否也同时失效了呢?

我需要马上离境一年后再申请新的六年的h1b吗?

如果再申请一次140,批准后还可用这份被拒过的485的140的pd吗?谢谢!

-YOu don't need to file another EB2 I-140. YOur NIW I-140 is still valid even if your current I-485 is denied and you can use it to file your I-485 again. Also, you can continue to renew your H1 beyond the 6 year h1 limit using the currently approved NIW I-140.
