从TN 到绿卡

请问，我现在是拿TN签证在美工作, 如果我不转H1B,而直接申请EB3,那么3年后我申请TN续签的时候， 边境的 移民官会拒签我吗？还有， 我需要告诉我的雇主， 我不需要转h1B, 直接申请EB3吗？现在申请Eb3, 大概需要多长时间？谢谢
