老师，我想请教一个问题，我是大学H１B， I１４０NIW已经APPROVED，我递过一个I－４８５，已经打了指纹，拿到EAD和AP卡，（昨天收到移民局给我的支票，把CASH我的钱又退回来了，但是没受到任何NOTICE，网上状态是INITIAL REVIEW。
我现在被大学LAYOFF了，最后一天工作日是４月３０日，我去EDD申请失业救济时，应该怎么填才能拿到失业救济呢？填A－NUMBER，还要填EAD卡号吗？

-YOu have to find a job as soon as possible and do H1 transfer. If your H1 transfer approval has no I-94, you need to go back to China or Canada (if your current I-94 is valid) to get the H1 visa to come back.
我在受到I－４８５的NOTICE之前，是不是还算AOS状态，还能合法留在美国吗？
-Normally no one will bother you if your current I-94 is still valid.
因为是把支票退回，我猜想是移民局认为我排期不到不受理我的４８５，当时是误收，所以把我的支票钱退还给我了。
-Do you mean you filed your I-485 when your priority date was not currrent? If so, your I-485 will be invalid and thus, you can not use EAD and AP. You can not file any appeal or MTR (you will not win it).
这种情况，我能APPEAL吗？APPEAL其间能合法留在美国吗？谢谢
