老公的485 current乐,但是公司说他的工资没有达到prevailing wage,不让递交
我们就找外面的律师办,
外面的中国律师给的sample EVL给单位签字,local HR partner答应签字了
但却说要给regional HR看一下
这一看,regional HR回答说不能签
因为我们的case就是不能递交,如果签字递交了,就把他们公司put in risk (他们说这是misrepresentaion)
然后我问了现在的律师,我问他standard employment letter可以吗?,他一开始说总比没有强,
后来他的意思是可以只交paycheck, W-2,那种standard employment letter也不要交了
我问这种情况成功率多少,他说一半一半吧,
-Agree with the lawyer. It is also OK to provide the recent-6 month paycheck stubs and the H1 approval notice with I-94. Of course EVL is better.

-Yes. He may file his I-485 now to see what will happen, then you can file yours later if eveything goes well. Thus, you can save some money if something wrong.
这个EVL一定要绿卡模式的还是standard letter也可以阿?
-Standard letter is also OK as long as it addresses his title, duties, salary and indicates the job has no definite term and he (your spouse) has the expectation to be employed continually. His current salary deos not matter that much because the prevail wage is the one after getting green card.
