我家成员属加拿大公民， 持H1B 和H4签证居住美国 (一孩子在加拿大上大学)，移民申请排期临近，现准备递交I-485。请问在加拿大上学的孩子( 持H4签证) 如何申请移民身份调整?

 

可能有以下选择: 1) 所有家庭成员的I-485同时递交。

 

 在外上学的孩子是否必须在递交申请时返回美国?

 -Not need. All  your plans here are doable.

  

 2) 主要成员在美国递交I-485，在外上学的孩子同时在加拿大申请移民身份调整。

-This procedure is called immigration visa application outside US (in Canada in your case) using consulate processing. It is a good choice if your child will stay in Canada for a longer time. You just need to file I-824 for your child together with your I-485 filing, or file I-824 any time later after you file I-485.

 

 3) 主要成员在美国先递交I-485，在外上学的孩子在暑假返回美国后再递交I-485。

 

请分析各种选择的利弊。哪种选择比较好?

-If your child will stay in Canada for a short period of time,  choose 1) or 3), otherwise choose 2).



 

在等待身份调整批准期间，在外上学的孩子能否持H4签证自由往返美国?

-Yes unless your I-485 is approved.

是否需要申请 Advance Parole Document 才能自由往返美国

-If he/she choose 1) or 3),  he/she had better have AP in case your I-485 is approved before he/she returns to US
