有的同学在当前身份失效，且没超出 180 天的时候，认为由于有 245(k) 的保护，所以仍然可以提交 I-485. 这种认识是不全面的。因为 245(k) 豁免的是工作移民的少于 180 天的身份违例，但是并没有豁免当前身份失效。
在来看看USCIS的 Memorandum
其中有段文字如下
3(d)(4)(C)
Failed to Maintain a Lawful Status and/or Violated the Terms of a Nonimmigrant Visa.
(1) General. Expiration, revocation, or violation of status puts a nonimmigrant out of status, and the alien remains out of status until some adjudication restores status or the alien departs the United States.
In most cases, the 180-day counting period commences on the date the alien’s status expires, is revoked, or is violated following the alien’s most recent admission.
“身份违例”不就是“OOS”吗？OOS不向USCIS要个身份，OOS就保留至当前。怎样理解您的“身份违例”同时还不“当前身份失效”？
