Actually it's really a bad news for my family because it has wasted lots of energy,money and time, especially for the time.AAO took 1year to reject appeal and about 2years to dismiss MTR.I thought I had hope for my 1st NIW and I could not apply petition therefore the time was consumed. 可以说是被移民局活生生拖到这一步:不作判决取代改判而让你另想法去放弃--因为时间限制.
Currently my wife is taking MS program and will have internship this summer and then graduate. She has EAD based on I485 although she has not used it. At first I hoped she could renew it from May while MTR's pending no matter it would be approved or denied. Now is it possible to renew it and then apply H1B?
Another question, is the time for H4 counted in the 6year of H1?
