我2010年8月22日回国， 当时我的H4 I797已经批准, 过期日是2012年3月10日。
9月16日回美， 入关时， 移民官没有看我的I797, 根据我的Visa的过期日在我
I-94上签的expired date是2011年8月25.
今天被律师助手告知我已经out of status, 请问:
1.) 如何改变现在的status问题?
2.) 重要的是， 我正在绿卡申请， 3月11日后21岁， 这是否会影响我的I-485批准？
-Have you filed your I-485 yet? If yes, you will be OK. Or if you can file your I-485 before your unlawful presence is > = 180 days, you will alos be OK (using 245 (k) benefits). Otherwise you need outside US (e.g. China or Canada) to get the H4 visa immediately (before your unlawful presence is > = 180 days).
