我是主申请人。我和我妻子都是h1b。我们12月可以递485申请。律师应该可以在下个星期提交485。我妻子的H1b十二月底到期，不能延期。我的问题是

（1）在提交485后，需要给我妻子办理h4吗？

-Up to her.

如果485的收据来的比我妻子h1b到期晚，而又没有办h4，她的身份是不是合法？

-Fine as long as her I-485 is mailed out 3 to 4 days before her I-94 expires.

（2）办理h4是不是一种更安全的选择？还是办不办都一样？

-Does not matter. As long as you keep your H1 valid, she can apply for the H4 visa outside US to come back to get the H4 status if her I-485 is denied. She can apply for the AP for travel and EAD to work during the I-485 pending.
