8老师，非常感谢你的回答！我看了有些律师的网站，说要符合三个条件：1.小孩小于16岁；2.监护2年；3.共同居住两年才符合DEPENDENT的条件。我们不符合条件3是不是我们的硬伤所以不给签H4?

-Don't listen to the lawyer. Obviously the VO did not care about "共同居住两年" because the denial reason is that the VO thought your child had "immigration intent" -214(b) and thus, he/she refused the H4 visa application. "共同居住两年" is required for immigration visa/green card application, not for non-immigration visa such as H4, F2, L2 etc. So, just do what I suggested above.

 你觉得签B2是不是不会碰到条件3的硬伤呢？我们当时用中信递的，一周后使馆打电话叫我先生去面试，之后又进行行政审查3周，最后收到拒信。我们现在是不是再试递一次B2申请？

-Just try H4. Because B2 visa is not dual intent and the VO may use the same reason to deny the B2 visa application.

试试看又没有希望，如果不行，还有什么其他办法吗？再次感谢回答
