回复：老师,急问公司换名字对485的影响

 

各位老师,EB2 6/2007, 刚刚提交485. 现在公司给办H1延期(明年1月到期),发现问题.09年时(140已批)总公司给我们公司换了个名字和税号,但工作内容要求和地点一切不变.当时问公司HR是否要H1 AMEND 和影响绿卡,HR说不影响(说老公司还是我的legal employer, 好象总公司想让老的公司名字慢慢的退出),

就什么也没做.

现在要H1延期,公司律师讲要AMEND AND EXTENSION并用加快 (不知他们09年为什么没有发现这个问题).

- If the H1 amendment at this time is used one I-129 together with the H1 extension, that is fine and not need premium processing if the fee is paid by you. If the lawyer uses one I-129 for amendment and another I-129 for the h1 extension, that is ridicular.

我485律师是自己找的.

这月初485提交时还用老公司的名字.我的485是否就有问题了?

-No problem at all.

我是否有successor-in-interest保护?

-Yes.

是否晚点交或不交H1延期,希望485就批了或用EAD if possible?

-Up to you. The H1 extension has to be filed before your current H1 expires. You can also choose to use EAD, not extend your H1.

还是尽快重新办PERM(痛苦啊).

-Not need.
