你好八先生,我是EB3 PENDING,最近丢了工作.现有两个问题请教:

1.新的工作付1099 而不是W2 能满足移民局的要求吗?

-May be fine as long as the new job is in the same/similar area if your I-485 is pending > 180 days. If your PD is not current, you may not need to worry about it at this time because USCIS may not care about your case at this point. So, try to find a secure job.

2.若485被拒,是否须马上离开美国,有没有转成其他签证的时间和可能?

-H4, L1, not F1 nor B1/B2 due to immigration intent.
