我现在是H1B ，现在准备申请L1， 律师说， 明年1月前可以拿到. 现在有以下问题：
1. 我们准备1月份回上海过年， 如果1月份拿不到L1 的批准， 是不是可以仍旧以 H1B 申请新签证。
-Yes if the H1 sponsor still hire you.
最好是拿到， 那么我们可以直接申请L1 签证了。
2. 如果可以申请H1B 签证， 等回美后拿到L1. 是不是需要仍旧回上海重新改签证类别，还是仍旧可以呆在美国， 直到下次回到中国。
-Two kind of situations:
1. If you enter US using H1 visa first, then the L1 petition is approved later, you can continue to work and nothing needed to do;
2. If your L1 is approved before you return to US and you use the H1 visa to enter US, then you need to change your H1 status to L1 again as you do now or go outside US to get the L1 visa to reenter US.
