新公司是research corperation, 应该是non-profit.希望能申请到 cap-exempt.

如果被拒: 我现在I94 也是八月底到期,如果申请cap-subject,我还能在九月份在新公司工作吗?

-If non-cap to non-cap, you can work after the H1 transfer is filing. If non-cap to cap, you can not work but legally stay in your case after the h1 transfer is filing.

 还是要回国才行?

-Not need.

这种情况下USCIS 不会给带新I94的I797, 对吗?

-Either way, you will get the new H1 I-94 after the H1 transfer is approved.
