回复：棘手绿卡入境

夫妇二人09年底海归，海归前老公已入籍，老婆只持有十年绿卡。海归至今老婆没回过美国。现在二人决定归海，老公已找到美国工作，老婆正在找。老婆虽有十年绿卡但离开美国一年半害怕入境时有问题。当时离开美国出境没有盖章，但是出入中国境的时候有盖章，害怕移民官一仔细看时间就有问题。如果移民官没有看中国的出入境章，问老婆离开多长时间，该怎么回答，能不能说只有几周，

胡说八道后有两种情况，a.蒙混过关，

-I don't think she can do that sucessfuly and the consequence is very serious.

b.移民官又细看中国的章。b的后果是什么?会被立刻遣返吗？以后入境会有问题吗？

-All are possible.

如果没被遣返而只是吊销绿卡，重新申请有问题吗？如果当时答问的时候老公也在一起，他该怎么作答？他胡说八道又有什么后果。能否他说不清楚情况，一切都是老婆自己在弄。（顺便说下，当时很多原因老婆无法定期回美国维持绿卡。否则也不会像现在这么麻烦）。

-Her green card is invalid if she has no reentry permit and there is not other unavoitable causes which prevent her to return US in time such as serious illness,, natural disaster, etc.

She may actively give up the green card in the US Consulate in China and then, apply for the B2 visa to enter US. Then, she can apply for the green card again using family based category.
