-No. You can file NIW I-140 any time. As long as the NIW I-140 is approved before the H1 reaches the 6 year limit, they can extend their H1 for another 3 years beyond the 6 year limit. So, I strongly enourage them to do that. Had better find a good lawyer to help them.
