朋友一家人非常好，先生postdoc，几年来未重视并积极办绿卡，现在刚刚进入H1-B
第六年。通过老板，学校也答应给办EB2 Perm, 但因太晚学校律师最近说过了deadline
不能办了。

-This lawyer is stupid. Tell the lawyer that your friend can use premium processing to get the I-140 approved and then, he/she can extend the H1 for another 3 years beyond the 6 year limit. So, ask the school to file the PERM as soon as possible.
请问：

1.EB2有这个5年Deadline吗？

-If the I-140 is not approved and the PERM fiing is less than one year when the H1 reaches the 6 year limit, you can not extend the H1 beyond the 6 year limit. But because you can use premium to get the I-140 approved in 15 days, it does not matter too much to file the PERM even if it is less than one year when the H1 reaches the 6 year limit. After the I-140 is approved, you can extend he h1 beyond the 6 year limit no matter when the PERM is filed.

NIW也有吗？
-Yes. You can not use premium processing for NIW I-140, so NIW I-140 had better be filed one year before the h1 reaches the 6 year limi.

2.能不能加快，需要什么条件可以加快？

-Yes for PERM based I-140, not for NIW I-140.
