我目前是H1B， LG是F1， 上星期刚刚申请了OPT。 

现在排期当前，8月份准备递交485， 131和765.

但是由于国内家中有事，LG必须在8/23回国。

我的问题是：这种情况下，8月份之后，LG可不可以在中国申请H4签证回美国？

-Because his status is not H4 or H1 before he leaves US, his I-485 may be affected if he has not AP even if he uses H4 visa to come back.

 已经申请的AP是否就作废了？

或者有没有什么更好的方法解决？

-He may not file I-485 until he uses H4 visa to come back. It seems the priority date may not turn back in the next few months.

 

Emergency AP 可能来不及。
