-It does not matter whether USCIS know it or not.

他可以去中国的领事馆再申请一个H visa?

-Yes as long as the H1 approval notice does not expire yet. If it expires, his employer can file a new H1 (h1 extension) for him and use premium processing to get it approved in 15 days and then, send the approval notice to him to apply for the H1 visa to come back. So, don't worry. 

Of course, if your status is H1, he can apply for the H4 visa to come back and use EAD to work.
