These people misunderstood the immigration law. Most of us entered US with non-immigration visa such as J1/J2, B1/B2, F1/F2 got the green card in US. But the J1 scholar needs to get the J1 waiver before filing I-485, but I-140 filing does not need the J1 waiver.
