我爸在这里越期呆了5年给我们看小孩。今天在外面出了点事被警察抓住了。我现在很急，想求助大家。

1.他还能不能放出来，他如被驱逐出境，我们可不可以自己要求走？

-Are you live in AZ? What kind of police arrested him, regular police or CBP officer (note: CBP officer only arrest illegal immigratant)?. If he does not committed a serious crime, he may be free by bond, so just consult a professional lawyer.

他如被驱逐出境，我们可不可以自己要求走？

-Yes. he will have the hearing in the immigration court and then, he can choose to leave US volunteerlly. But because he has been unlawfully present for more than one year, he will not allowed to enter US within 10 years.

2.我们现在正在办绿卡，对我们有没有影响？

-Not at all!
