我的h1b年底到期,需要转成h4.我有几个问题。麻烦知情者相告。万分感谢!
1. 一般需要提前几个月申请?
-As long as USCIS receives your change of status applicaiton before your H1 ends, you are fine.
2. 在申请时可否指定生效起始日期?
-No.
希望能充分利用目前的h1b :-)
-Send the applciation just in advance two weeks to one month, and thus, you can work during the h4 application pending until your H1 ends or H4 approval whichever earlier (USCIS take some time to approve your H4).
3. 如果不能指定生效起始日期,一旦h4被批准，是不是当前h1b自动失效，即便还有剩余时间?
-Yes.
这样的情况下是不是要立刻辞职?
-Yes.
4. 可以自己申请吗？ 还是必须通过老公的公司律师？（公司律师一般反应比较慢，所以如果能自己申请，我们打算自己申请）
-Do it by yourself, not the company's business.
