Could she use the approved AP?

-Yes, of course. If she uses AP, her status will be parolee for one year and then, becomes AOS. After she uses AP, she still can work for her current employer without using EAD and then, she can extend or transfer her h1 before her current h1 status expires and after her h1 extension or transfer is approved, her status will be H1 again.

Her situation is that her H1B expires in OCT2011. The lawyer in her company already filed her H1B extension. Suppose she use AP this August. And her H1B extension get approved in OCT2011, she will be in parolee status for 2 monthes (Since her using AP this August and approval of her H1B this October)? When her priority date is update (her PD is Feb2008) and she apply I-485, she will be treated as if she was never in parolee status (two monthes)?
