If I am benched, am I still employed under H-1B?

Is there any regulation saying that if an H-1B holder doesn't get paid, he is no more H-1B holder? If I have 3 years H-1B, and I only get paid in the first month of the first year and the last month of the 3rd year, have I been employed by my employer (my H-1B sponsor) for 3 years?
