I am a Canadian. My I485 被拒  (J1   没有 WAIVER) and H1B (6 years) will be expired in the end of May. I have got a new job offer recently.

 

1, Can I apply for TN visa?  

 

 被拒的可能性大吗？

-Yes due to the immigration intent.

 

 If I apply, which is better, apply to USCIS or CBP?

-If you go to the port of entry, you may have a chance though it may be small, but if you file I-129 to USCIS for TN, the  chance may be zero.

2. TN  看来有点风险，是否我可以重申请新的I-485 with老的I-140 以获得 EAD?

-Yes, but you waste a lot of money again and your I-485 will be denied again. But you can extend your H1 beyond the 6 year limit using the approved I-140 and I think this is the best choice to you,

3. 要多久才能够收到I-485 application receipts and EAD？
