I currently work with H-1B in a company without taking any Green card Application, and 6 yrs H-1B period will be expired at the end of year. And I had I-140 approved in previous company almost 3 yrs ago.
Question 1: Can I renew/transfer my H-1B visa with other 3 yrs in the current company? how about with other new offer?
-Yes, you can if the approved I-140 has not been withdrawn by the sposnor. If it was withdrawn, you can not use it for the H1 extension/transfer beyond the h1 6 year limit.
Question 2 what will happen if I try to get visa from China in August.
-It should be fine to use your current h1 approval notice to get the visa if you still work for the compnay and the h1 does not expire yet.
