回复:本周内部门解散,H1b Transfer紧急情况请教老师们!!!

我办H1b Transfer到现单位刚补交了材料,还没批下来,今天获悉公司准备在本周内解散我们部门. 我的最后一张paycheck可能截至3月10号. 时间如此紧急的情况下,在维持身份上我有什么选择呢?

1. 如果我立刻开始找工作,假如顺利,在一个月之内递交新的H1B Transfer申请,身份上算不算有gap? 需要出境签证吗? IT IS FINE IF YOU CAN FIND A NEW H-1B SPONSOR (NEW EMPLOYER) WITHIN A MONTH. MAKE SURE ON FORM I-129 PART 2, 2. MARK "a" "NEW EMPLOYEMENT" & 4. "c" EXTEND THE STAY ....." THIS WAY YOU DO NOT NEED TO GO OUTSIDE THE U.S. AND YOU CAN CONTINUE TO WORK AS H-1B. 

我知道如果当前的H1b批准,一个月gap是允许的. 可是我的情况是当前的H1B刚补充了材料,还在等待批准.要是提交一份新的申请,那岂不是在移民局同时申请两份不同的工作,导致统统被拒掉么?有没有可能在提交新申请的时候通知移民局撤销老的申请?填表上有这一项吗?我已不指望现公司能留意到我的情况去主动撤销我的申请,对于这个烂公司不敢抱任何希望.AS LONG AS YOUR CURRENT EMPLOYER DOES NOT NOTIFY CIS TO WITHDRAW ITS H-1B, YOU ARE FINE. YOU SHOULD GET CURRENT H-1B FILING RECEIPT IN ORDER TO PROVIDE IT TO NEW EMPLOYER. THEY NEED TO SUBMIT IT TO CIS WHEN THEY FILE H-1B TRANSFER PETITION FOR YOU.

2. 如果我转H4,可以在离职一个月之内提交吗?我很希望能有两三周时间找找新工作.因为H4办下来也要三到四个月,之后再找再办H1B,实在不愿意那么长时间不工作.

TO BE SAFE, YOU SHOULD FILE CHANGE OF STATUS FROM H-1B TO H-4 NOW IF YOU ARE CERTAIN THAT YOU WILL LOSE THIS JOB. YOU CAN ALWAYS CHANGE BACK TO H-1B ONCE YOU FIND NEW EMPLOYER EVEN IF AT THE TIME YOUR H-4 APPLICATION IS STILL PENDING. YOU WILL HAVE A FILING RECEIPT TO PROVE THAT YOU ARE TRYING TO KEEP IN LEGAL STATUS. THIS WAY YOU ARE CERTAIN THAT YOU WILL NOT HAVE ANY GAP IN BETWEEN.
