-The organziztion has to have the ability to pay the foreign employee at the prevail wage level of PERM and has to follow the PERM procedure to advertise the position and recruit the employee. Your friend had better find a lawyer to help him/her.

-Based on the law, the employer needs to pay the lawyer fee for PERM filing, position advertisement fee and PERM filing fee, and the employer does not have to pay the I-140/I-485 filing fee (the employee has to pay it if the employer does not pay that fee). Sometimes some employers pay all the fee, whereas sometimes the employee pay all the fee. So, actually it is between the employer and the employee and normally nobody check it seriously.
